Aerosol Cans Added To Universal Waste Program

Effective February 7, 2020, the U.S. Environmental Protection Agency (EPA) is adding aerosol cans to the Universal Waste (UW) program under the Resource Conservation and Recovery Act (RCRA). The EPA defines an “aerosol can” as a “non-refillable receptacle containing a gas compressed, liquefied or dissolved under pressure, the sole purpose of which is to expel a liquid, paste, or powder and fitted with a self-closing release device allowing the contents to be ejected by the gas.” There is also an allowance for leaking and damaged aerosol cans to be managed as universal waste as well. According to the Consumer Aerosol Products Council, up to 1,500 kinds of products are packaged as aerosols. While aerosols are currently classified as hazardous waste across the country, some states have already added them to their list of items that can be managed as universal waste. This change in the EPA rule will benefit a wide variety of companies generating and managing aerosol products, including the retail sector. In addition, the EPA developed guidelines for managing all components of aerosol cans from transportation to recycling.
